1. General
1.1. These terms apply to all bookings of WuudStay accommodation and to orders of extras and gift cards made on wuudstay.ee or directly with us by e-mail or phone.
1.2. The service provider and contracting party is EstLandlord OÜ (trading as WuudStay; “WuudStay”, “we”), registry code 16561835, VAT no. EE102808744, registered address Sõbra tn 42, Tallinn, Estonia. Property address: Sihi, Simiste village, Muhu Parish, 94719 Saare County, Estonia. E-mail info@estlandlord.com, phone +372 5197 0017. Type of accommodation establishment: holiday home.
1.3. “Guest” means the person who makes the booking and every person staying at the house under that booking. Bookings can be made by persons aged 18 or over. The person who makes the booking is responsible for ensuring that their companions comply with these terms. If a booking is made for someone else (e.g. as a gift), the person making the booking is the contracting party and must make the actual guest aware of these terms.
1.4. Bookings made via Airbnb, Booking.com or another intermediary are governed, as regards price, payment and cancellation, by the terms shown on that platform at the time of booking. The house rules (section 7) apply to all guests.
1.5. The terms are published in Estonian and English. In case of discrepancy the Estonian text prevails.
2. Booking and conclusion of the contract
2.1. To book, the Guest selects the arrival and departure dates in the calendar and any extras, enters their details, confirms acceptance of these terms and pays for the booking.
2.2. The contract is concluded when we have received the full booking amount and sent a booking confirmation to the Guest’s e-mail address. An unpaid booking does not hold the dates and is cancelled automatically.
2.3. The confirmation states the booking number, dates, price and cancellation terms. Please check the details and tell us immediately about any error.
2.4. The Guest is responsible for the accuracy of the contact details provided – arrival information is sent to the e-mail address given at booking.
3. Price and payment
3.1. All prices are in euros and include VAT. The total price shown at booking is final; later price changes do not affect a confirmed booking.
3.2. The price includes use of the house and sauna for up to two adults, bed linen and towels, final cleaning, parking and Wi-Fi. Extras (e.g. pet fee, baby cot, sparkling wine) can be ordered at booking or no later than 2 days before arrival at the price shown on the website.
3.3. Payment is made in full at booking by bank link or bank card (Visa, Mastercard). Payments are processed by Montonio Finance UAB; we do not see or store the Guest’s bank or card details.
3.4. One discount code can be used per booking. A code cannot be applied retroactively to a confirmed booking or exchanged for cash.
3.5. For a company invoice, please send the company details to info@estlandlord.com.
4. Cancellation and changes by the Guest
4.1. Accommodation is booked for specific dates; therefore the 14-day right of withdrawal that applies to distance contracts does not apply to accommodation bookings (Estonian Law of Obligations Act, § 53 (4) 7²). A booking can be cancelled on the conditions set out in this section.
4.2. To cancel or change a booking, send an e-mail to info@estlandlord.com stating the booking number and the name of the person who booked. The time of cancellation is the time the e-mail reaches us (Estonian time). We confirm receipt no later than the next working day.
4.3. On cancellation we refund the following share of the accommodation price paid:
| Time of cancellation | Refund |
|---|---|
| Within 24 hours of the booking confirmation (if arrival was at least 7 days away at the time of booking) | 100% |
| 30 days or more before arrival | 100% |
| 29–7 days before arrival | 50% |
| Less than 7 days before arrival, no-show, late arrival or early departure | 0% |
Days are counted from 15:00 on the arrival date. Example: for arrival on 31 July, free cancellation is possible until 15:00 on 1 July and a 50% refund until 15:00 on 24 July.
4.4. Pre-ordered extras are refunded in full if the cancellation is notified before the arrival date.
4.5. If we manage to resell the cancelled nights, we will additionally refund the amount retained under clause 4.3 to the extent covered by the new booking, less a 10% handling fee.
4.6. Changing dates. The dates of a confirmed booking can be changed once free of charge if the request reaches us at least 7 days before arrival, the new dates are available and the new arrival date is within 12 months of the original arrival date. If the new period is more expensive, the Guest pays the difference; if it is cheaper, the difference is not refunded. After a change, the lower of two refund rates applies on cancellation: the rate that applied at the time of the change or the rate calculated from the new arrival date.
4.7. A booking may be transferred free of charge to another person aged 18 or over by giving us that person’s name and contact details before arrival.
4.8. The cancellation terms apply regardless of the reason for cancelling (including illness, work, weather or transport disruption). We recommend taking out travel cancellation insurance. For ferry disruptions see clause 5.2.
4.9. Refunds are made within 14 days of cancellation to the bank account or card used for payment.
5. Cancellation by WuudStay and exceptional circumstances
5.1. If we cannot provide the accommodation – whether due to force majeure (e.g. fire, storm damage, prolonged power or water outage, restrictions imposed by authorities) or another obstacle (e.g. a fault we cannot repair before arrival) – we will inform the Guest without delay. The Guest may choose between new dates and a full refund.
5.2. If the Virtsu–Kuivastu ferry service is suspended on the arrival date due to weather and the Guest is therefore unable to reach Muhu, we offer new dates within 12 months free of charge or a gift card for the amount paid. Please inform us immediately.
5.3. In case of an obvious pricing error (the price clearly differs from the usual price, e.g. due to a system error) we may cancel the booking within 48 hours of it being made, refunding the full amount paid.
5.4. In case of a material breach of the house rules (e.g. a party, more overnight guests than permitted, smoking indoors, danger to people or property) we may end the stay after a warning, or immediately in case of danger; unused nights are then not refunded.
6. Arrival and departure
6.1. Check-in from 15:00, check-out by 12:00. Early check-in or late check-out only by prior arrangement.
6.2. Entry is by door code. We send arrival information and the guest guide by e-mail no later than 2 days before arrival. The door code must not be shared with third parties.
6.3. Under § 24 of the Estonian Tourism Act we are required to register visitors’ details (including name, date of birth, citizenship and place of residence) and keep them for two years. Please provide these details on arrival at the latest.
6.4. On departure please switch off the sauna and lights, close the windows and doors and leave the house in a normal tidy state (dishes washed, rubbish collected).
6.5. We keep items left behind for 30 days and can post them on request at the Guest’s expense.
7. House rules
7.1. The house is intended for two adults. One child up to 2 years of age may stay as well. Additional guests, including day visitors, are allowed only with our prior consent. Parties and events are not allowed.
7.2. Smoking (including e-cigarettes and vaping) is prohibited in the house, in the sauna and on the terraces.
7.3. Open fire, bonfires and fireworks are prohibited. Barbecuing is allowed only on the charcoal grill in the designated area; wood collected from the grounds must not be used.
7.4. Pets are allowed only by prior arrangement and for an additional fee. Pets must not be left alone in the house or allowed on the bed; the owner cleans up after the pet and is liable for any damage it causes.
7.5. The sauna, bathtub and appliances must be used as described in the guest guide. Only clean water may be thrown on the sauna stones; do not dry clothes above or near the heater. Children may use the sauna only with an adult.
7.6. Furnishings and equipment must not be taken out of the house; terrace furniture is for use on the terrace.
7.7. The house is located in a forest. Insects, ticks, wildlife and weather are part of the natural environment and do not constitute a defect in the service. Please respect nature and the neighbours.
7.8. There is a security camera in the car park, covering the car park only. There are no cameras in the house, in the sauna or on the terraces.
7.9. Photography and filming for commercial purposes (e.g. advertising, product shoots) is allowed only with our prior written consent.
8. Liability and damage
8.1. The Guest uses the house and its furnishings with due care and compensates for damage caused to the house, furnishings or grounds by the Guest, their companions or pet. Please report any damage immediately.
8.2. If we discover damage, we inform the Guest as soon as possible, normally within 3 days of departure, with photos and the basis for the cost. Damage is compensated on the basis of an invoice within 7 days.
8.3. In case of a breach we may charge a contractual penalty:
- smoking in the house or sauna – €150;
- pet not agreed in advance – €100;
- party, event or more overnight guests than permitted – €200;
- late check-out not agreed in advance (more than 30 minutes) – €50.
Where substantially more cleaning than usual is needed, the actual cost of the extra cleaning is added, minimum €50. A contractual penalty does not exclude compensation for damage exceeding it.
8.4. We are not liable for loss of or damage to the Guest’s personal belongings or vehicle, except where the damage was caused by our intent or gross negligence.
8.5. These terms do not exclude or limit our liability where the law does not permit it, nor the Guest’s statutory rights.
9. Defects and complaints
9.1. If anything is wrong on arrival or during the stay, please tell us immediately by phone on +372 5197 0017 (calls until 21:00, in emergencies at any time; otherwise by message). If possible, take a photo. This lets us resolve the situation quickly.
9.2. We remedy defects within a reasonable time. If a material defect cannot be remedied, we offer – depending on its seriousness – a price reduction, new dates or a refund for the affected nights.
9.3. If the Guest does not report a defect during the stay and thereby deprives us of the opportunity to remedy it, this is taken into account when determining compensation (Law of Obligations Act, § 139). This does not limit the Guest’s statutory rights.
9.4. Written complaints should be sent to info@estlandlord.com with the booking number, a description and, if possible, photos. We acknowledge receipt and reply in writing within 15 days.
9.5. If we reject a complaint or the Guest is not satisfied with the solution, a Guest who is a consumer may turn to the Consumer Disputes Committee at the Estonian Consumer Protection and Technical Regulatory Authority (Endla 10a, 10122 Tallinn, avaldus@komisjon.ee, www.ttja.ee). The procedure is free of charge for the consumer. Consumers living in another EU country can get advice from the European Consumer Centre of Estonia (www.consumer.ee). The Guest also has the right to go to court.
10. Gift cards
10.1. Gift cards are virtual and are sent to the buyer’s e-mail address once the invoice has been paid. Each gift card carries a unique code, a value and an expiry date.
10.2. A gift card is valid for 6 months from issue; the stay must begin within the validity period. The validity can be extended by agreement before it expires.
10.3. To book with a gift card, please write to info@estlandlord.com. Bookings are subject to availability. If the booking price exceeds the value of the gift card, the Guest pays the difference; if it is lower, the balance can be used for extras. Gift cards cannot be exchanged for cash.
10.4. A consumer may withdraw from the purchase of an unused gift card within 14 days of receiving it, without giving a reason, by sending a statement to info@estlandlord.com. We refund the money within 14 days of receiving the statement.
10.5. Section 4 applies to the cancellation of a booking made with a gift card; any refundable part is restored as a gift card valid for at least 3 months.
11. Personal data
11.1. The controller of personal data is EstLandlord OÜ. We process data to perform the booking, communicate with the Guest and comply with legal obligations (including accounting and visitor registration).
11.2. We share data only with partners needed to provide the service (payment service provider, booking management software, accounting). Details: Privacy Policy.
12. Final provisions
12.1. The contract is governed by Estonian law. This does not deprive a consumer living abroad of the protection afforded by the mandatory provisions of the law of their country of residence.
12.2. These terms apply for an indefinite period. A booking is governed by the terms in force at the time it was made. Amendments are published on the website and apply to bookings made after publication.
12.3. If any provision of these terms proves invalid, the remaining provisions stay in force.
